Texts, photos, graphics and the YAGI design are protected by copyright. The artworks on the Art Panels belong to the respective artists. Any use beyond the legal limits requires our written consent or that of the artists.

Contracting party

The contract is concluded between you and Retro Yagi (brand: YAGI), owner Yagmur Asar, Simon-Dach-Straße 36, 10245 Berlin, Germany.

Subject of the contract

These terms govern the sale of new fashion goods through the YAGI online shop: modular denim jackets, Art Panels and items from the Retro Collection. Details are given in the respective product description. Custom and hand-painted Art Panels are available on request. They are only made after you have ordered them.

Conclusion of contract

The products in the shop are a non-binding invitation to place an offer. You order as follows: choose a product (size, color, quantity), add it to the bag, enter your address and payment method, check your order and click “Order with obligation to pay”. The contract is concluded with the order confirmation by e-mail.

Retention of title

The goods remain our property until they have been paid in full.

Prices and shipping costs

All prices are final prices in euros. As a small business under § 19 UStG we do not charge VAT, so it is not shown. Shipping costs per order: Germany €4.90, free from €149. EU €12.90, free from €199. Other countries on request. For partial deliveries, shipping costs are charged only once. If you exercise your right of withdrawal, we bear the cost of the return shipment.

Payment

You can pay with the payment methods shown at checkout, currently PayPal, credit and debit cards (e.g. Visa, Mastercard), Klarna, Apple Pay and Google Pay. We do not offer other payment methods. Payment is due when you place your order.

Delivery

We ship within 1–2 working days. Delivery takes 2–4 working days within Germany, 3–7 working days to the EU and 5–10 working days worldwide. Custom and hand-painted panels are shipped as soon as they are finished. We will inform you of any delay immediately.

Warranty

The statutory warranty under the German Civil Code (BGB) applies.

Withdrawal and returns

You have a statutory right of withdrawal of 14 days, see the withdrawal policy. In addition, you can voluntarily return items free of charge within 30 days of receipt if they are unworn and in their original condition. There are no direct exchanges: return the item and place a new order. Custom and hand-painted panels are excluded from withdrawal and returns, even if they are included free of charge in a set. If you return the jacket and keep a panel, we deduct it from your refund at €29.99.

Contract text, language and law

We send you the contract text with your order details by e-mail. The contract is concluded in German. German law applies; mandatory consumer protection provisions of your country of residence remain unaffected. The German version of these terms is legally binding; this English version is a courtesy translation.

Severability

If any provision of these terms is or becomes invalid, the remaining provisions stay valid.

Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

03 · Withdrawal

Withdrawal

Withdrawal policy and model withdrawal form

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods. If you order several goods in one order that are delivered separately, it runs from the day you receive the last item.

To exercise your right of withdrawal, you must inform us (Retro Yagi, Simon-Dach-Straße 36, 10245 Berlin, Germany, e-mail: info@yagifashion.de, phone: +49 176 21167335) of your decision to withdraw from this contract by means of a clear statement. You can do this by letter, by e-mail or with the withdrawal function on this page. You may use the model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including standard delivery costs, without undue delay and at the latest within 14 days from the day on which we receive your notice of withdrawal. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise. You will not be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have sent them back, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event within 14 days from the day on which you inform us of the withdrawal. The deadline is met if you send the goods before the 14 days have expired. We bear the cost of returning the goods. You are only liable for any loss in value of the goods if it results from handling that was not necessary to establish the nature, characteristics and functioning of the goods.

No right of withdrawal for custom goods

The right of withdrawal does not apply to goods that are not prefabricated and for whose production an individual selection or decision by you is decisive, or that are clearly tailored to your personal needs (§ 312g (2) no. 1 BGB).

At YAGI this concerns custom Art Panels, i.e. panels with your own design, and hand-painted panels and pictures that an artist makes for you on your order. They are only made after you have ordered them and cannot be returned or refunded. This also applies if the panel is included in a set free of charge or at a discount.

Returning the jacket from a set

If you return the jacket from a set and keep an Art Panel, the set benefit no longer applies. This applies in particular to custom-made panels that are excluded from withdrawal. Example: you order the basic jacket with a free custom panel and return the jacket. We then deduct the panel at €29.99 from your refund. If you keep several panels, this applies per panel.

1. Controller

The controller for data processing on this website is Retro Yagi, owner Yagmur Asar, Simon-Dach-Straße 36, 10245 Berlin, Germany, e-mail: info@yagifashion.de, phone: +49 176 21167335.

2. Overview

We only process your data as far as necessary to run the website, handle your order and communicate with you. The legal bases are Art. 6 (1) lit. b GDPR (contract), lit. c (legal obligation), lit. f (legitimate interest) and lit. a (consent).

3. Hosting and server log files

The website is hosted by ALL-INKL.COM – Neue Medien Münnich, owner René Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany. When you visit the site, the server automatically stores data such as IP address, date and time, page visited, browser and operating system in log files. This serves security and stable operation (Art. 6 (1) lit. f GDPR). The log files are deleted automatically after a short time. A data processing agreement is in place with the host.

4. Shop, orders and customer account

For the shop, bag and order processing we use Wix.com Ltd., Yunitsman 5 St, Tel Aviv, Israel (EU representative: Wix Online Platforms Limited, 1 Grant's Row, Dublin 2 D02HX96, Ireland). In doing so we process name, address, e-mail, phone number, ordered items and payment data in order to fulfil the contract (Art. 6 (1) lit. b GDPR). Statutory retention obligations for invoices run for up to ten years.

5. Payment service providers

Depending on the payment method you choose, we pass on the data needed for the payment to the payment service provider, currently PayPal, Klarna, the card payment provider (Wix Payments) and Apple and Google when you use Apple Pay or Google Pay. We never receive your card data. The privacy policies of the respective provider apply.

6. Shipping

For delivery we pass on your name, address and, where needed for delivery or parcel notification, your e-mail or phone number to the shipping company, DHL (DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany).

7. Cookies and consent

We set technically necessary cookies (for example for the bag and language setting) without consent (§ 25 (2) TDDDG). All other cookies and similar technologies, i.e. Google Analytics, Meta Pixel and TikTok Pixel, are only set if you consent in the cookie banner (Art. 6 (1) lit. a GDPR). You can withdraw your consent at any time via the cookie settings in the footer.

8. Statistics: Google Analytics

If you consent in the cookie banner, we use Google Analytics 4 by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics sets cookies and evaluates how you use the website, for example pages viewed, time spent, approximate location, device and browser. We use it to improve the website. The IP address is shortened. Data may be transferred to the USA, based on the EU-US Data Privacy Framework decision. The legal basis is your consent (Art. 6 (1) lit. a GDPR, § 25 (1) TDDDG). The data is deleted after 14 months. You can withdraw your consent at any time in the cookie settings.

9. Advertising: Meta Pixel and TikTok Pixel

If you consent, we use the Meta Pixel (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland) and the TikTok Pixel (TikTok Technology Limited, 10 Earlsfort Terrace, Dublin 2, Ireland) to measure whether our ads on Instagram, Facebook and TikTok work. Data such as pages viewed, products in the bag, purchases, IP address and device information may be transmitted to the providers. We can use this to show ads to visitors of the website and measure campaign success. We are jointly responsible with the providers for part of the processing (Art. 26 GDPR). The legal basis is your consent (Art. 6 (1) lit. a GDPR, § 25 (1) TDDDG). Without your consent the pixels are not loaded.

10. Contact

If you write to us by e-mail, phone or social media, we store your details to answer your request (Art. 6 (1) lit. b or f GDPR). We delete them when they are no longer needed and no retention obligation applies.

11. Newsletter

If you sign up for our newsletter, we use your e-mail address to send you news, drops and offers from YAGI. Sign-up uses double opt-in: you receive a confirmation e-mail and are only subscribed after clicking the link. The legal basis is your consent (Art. 6 (1) lit. a GDPR). We store your sign-up with a timestamp in order to be able to prove it. The newsletter is sent via Wix (Wix.com Ltd., see section 4). Wix stores your e-mail address and sign-up data. You can unsubscribe at any time, via the link in every e-mail or by writing to info@yagifashion.de.

12. Instagram and TikTok

We run profiles on Instagram (Meta Platforms Ireland Limited) and TikTok (TikTok Technology Limited). On the website we link to them. When you click, you leave our site and the platform's privacy policy applies. If you write to us there or comment on posts, the platform processes your data; for the profiles we are jointly responsible with the platform. We process your messages in order to answer them (Art. 6 (1) lit. f GDPR).

13. Embedded services and fonts

We load fonts locally from our own server. No connection to Google is made and no IP address is sent to Google. We also play videos on our website from our own server, not via YouTube or Vimeo.

14. Your rights

You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21 GDPR). You can withdraw consent you have given at any time with effect for the future. Write to us at info@yagifashion.de.

15. Right to lodge a complaint

You can complain to a data protection supervisory authority, for example the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59–61, 10555 Berlin, Germany.

16. Security, changes

This site uses SSL/TLS encryption. We adapt this policy when our website or the legal situation changes. The current version applies. The German version is legally binding; this English version is a courtesy translation.
